1. Acceptance of These Terms

These Terms of Use and Privacy Policy (“Terms”) form an agreement between you (“User”, “you”) and MyGarbhakatha (“MyGarbhakatha”, “we”, “us”) governing your access to and use of the MyGarbhakatha pregnancy-journal application, website (garbhakatha.com), content, features and related services (the “Service”). By creating an account, ticking the acceptance box, or using the Service, you agree to these Terms.

2. Eligibility

The Service is intended for adults (18 years or older) who can enter into a binding contract under applicable law. You must provide accurate information and keep it up to date. We do not knowingly collect data from minors.

3. Nature of the Service

MyGarbhakatha is a pregnancy wellness, education, reflection and journaling platform. Features may include pregnancy-week information, journaling, reminders, mindful and bonding activities, breathing and relaxation practices, Garbhasanskar-related educational material and memory keeping. Features may change, be added, suspended or discontinued from time to time and may vary by plan or version.

4. Medical Disclaimer — Important

The Service is NOT a medical service and does not provide medical diagnosis, treatment, prescription, emergency care or personalised medical advice.

All information, educational material, activities, breathing or relaxation practices, Garbhasanskar content and wellness content are provided for general educational and wellness purposes only. Pregnancy is a medically sensitive condition and individual circumstances differ. Always consult your qualified obstetrician/gynaecologist, midwife or other healthcare professional regarding your pregnancy, exercise, diet, medication, symptoms and treatment.

Do not delay, avoid or discontinue professional medical care because of anything in the Service. If you have a medical emergency or concerning symptoms, stop using the relevant content and seek emergency medical care immediately — the Service is not an emergency-response service. Nothing in the Service creates a doctor-patient or other healthcare-provider relationship with MyGarbhakatha.

5. Activity, Breathing & Wellness

Your comfort and wellbeing come first. Every pregnancy is different, so please always consult your doctor or healthcare professional before starting any physical activity, breathing exercise or other wellness practice, and follow their guidance on what is right for you. Move gently, listen to your body, stay within your own comfort, and pause any activity whenever something doesn't feel right — reaching out to your doctor with any questions along the way. These practices are offered as gentle support, and your healthcare professional knows your individual pregnancy best.

6. Pregnancy Information & Personalisation

We may use your pregnancy dates, expected due date, pregnancy week and preferences to personalise your experience. Any pregnancy-week or due-date calculation is an informational estimate only and is not a medical determination — your healthcare professional's assessment takes precedence. You are responsible for the accuracy of information you enter.

7. What Data We Collect

We collect only what is necessary to provide the Service:

• Account information: Name, mobile number, email address, and password (encrypted).
• Pregnancy details: Due date, last menstrual period date, pregnancy number, doctor information.
• Usage data: Basic activity like login frequency. Your journal content is not analysed unless you turn on the optional AI reflection described in Section 9.

8. How We Use Your Data

• To provide and personalise your journal experience.
• To calculate your current pregnancy week and milestones.
• To store your entries securely so you can access them anytime.
• To send optional reminders and milestone notifications (if enabled).

9. Optional AI Weekly Reflection

MyGarbhakatha offers an optional“Weekly AI Reflection” feature that is turned OFF by default. You can switch it on or off at any time in Settings.

• When it is ON, the journal text you wrote for a completed week is sent securely to our third-party AI provider (OpenAI) to generate a short, warm written reflection for you.
• When it is OFF, nothing from your journal is sent anywhere — your Insights show only your own mood, habit and activity trends, calculated within the app.
• Our AI provider processes your text only to create your reflection and does not use it to train its models.
• AI reflections are supportive and informational only. They are not medical advice — always consult your doctor for health decisions.

10. Your Journal Content

You retain all rights in the journal entries, notes, photographs, drawings and other content you create (“User Content”). You grant MyGarbhakatha only a limited, non-exclusive, royalty-free licence to host, store, back up, format and display your User Content solely as needed to provide, secure and maintain the Service for you. We will not publish your private journal content as marketing material without your separate permission. You are responsible for ensuring your User Content is lawful and that you have the right to store any third-party information you enter.

11. What We Never Do

• We never sell your data to third parties.
• We never share your journal content with advertisers, insurance companies, or any external parties — except the optional AI reflection you choose to switch on (Section 9).
• We never read your journal entries for marketing or profiling. Only you can view your content within the app.

12. Data Security

Your data is stored on secure, encrypted servers. Each user's data is isolated at the database level — a strict guarantee that no user can access another user's data. Photos and media are stored in private, access-protected storage. No system is perfectly secure, and you are responsible for keeping your login credentials and device secure.

13. Your Rights

• Access: View all your data at any time in the app.
• Export: Download your journal data as a file.
• Delete: Permanently delete your account and all associated data yourself from Settings — no request to support is needed. Once deleted, it cannot be recovered.
• Modify: Edit or remove any journal entry at any time.

14. Cookies & Local Storage

We use essential cookies only for authentication (keeping you logged in). We do not use tracking cookies or third-party advertising cookies.

15. Prohibited Uses

You must not:

• use the Service for unlawful, fraudulent or harmful purposes;
• impersonate another person or misrepresent your affiliation;
• upload content that infringes intellectual-property, privacy or other rights, or that contains malicious code;
• attempt to gain unauthorised access to accounts, systems or data;
• reverse engineer, scrape, copy or commercially exploit the Service or its content except as expressly permitted by law; or
• interfere with the security, integrity or normal operation of the Service.

16. Intellectual Property

The Service — including its software, design, branding, logos, graphics, text, educational material, audio, illustrations and interfaces supplied by MyGarbhakatha or its licensors — is protected by intellectual-property laws. Apart from your limited right to use the Service under these Terms, no ownership rights are transferred to you. You must not copy, modify, distribute, sell or create derivative works from MyGarbhakatha content without prior written permission.

17. Third-Party Services

The Service relies on third-party providers, including a cloud hosting provider, an email delivery provider and an AI provider (OpenAI, for the optional reflection in Section 9). These providers are governed by their own terms and privacy policies, and process your data only to help us operate the Service. A link or integration does not constitute our endorsement of a third party.

18. Accounts, Notifications & Communications

You are responsible for activity under your account and must promptly notify us if you believe it has been compromised. The Service may send reminders, pregnancy-week notifications, wellness prompts and service announcements. Notifications are informational and are not a substitute for medical monitoring or emergency alerts. You may control optional reminders through your settings; essential service messages may continue where necessary to operate your account or comply with law.

19. Paid Services, Subscriptions & Refunds

Where MyGarbhakatha offers paid subscriptions, courses, consultations or other paid services, the price, billing frequency, taxes, renewal terms, cancellation conditions and refund rules will be disclosed at or before purchase. All payments are non-refundable— once a subscription, course, consultation or digital product is purchased, the amount paid will not be refunded, except where a refund is required by applicable law or a consumer right that cannot lawfully be excluded. For purchases made through the Apple App Store, Google Play or another marketplace, that marketplace's billing and refund procedures may also apply.

20. Every Pregnancy Is Unique

Every pregnancy — and every mother and baby — is beautifully unique. Many factors shape a pregnancy journey, and Garbhasanskar and the practices in MyGarbhakatha are one gentle, supportive part of it, not the whole picture. Because of this, experiences and outcomes naturally differ from person to person, and what one mother experiences may not be the same for another. We're here to support and accompany you, alongside the care of your doctor and loved ones.

21. Availability, Suspension & Termination

We work hard to keep the Service available and running smoothly. At times it may be temporarily unavailable due to maintenance or updates, or because it relies on third-party services (such as hosting and email providers) whose interruptions are outside our control. We may suspend or terminate access where reasonably necessary to protect users or the Service, to investigate suspected unlawful or abusive activity, for material breach of these Terms, or where required by law. Provisions that by their nature should survive termination will continue to apply.

22. Data Retention & Deletion

Account and personal data may be deleted, anonymised or retained in accordance with applicable law. Some information may be retained where necessary for legal compliance, fraud prevention, dispute resolution, accounting or security. When you request deletion, we will process it in accordance with applicable law and our data-retention practices.

23. Limitation of Liability & Indemnity

To the maximum extent permitted by applicable law, MyGarbhakatha will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of data, profits or goodwill, arising from your use of or inability to use the Service. We do not exclude or limit liability where the law prohibits it, including liability that cannot lawfully be disclaimed, and nothing here restricts statutory consumer rights.

You agree to indemnify MyGarbhakatha and its officers, employees and licensors against third-party claims arising directly from your unlawful use of the Service or material breach of these Terms, except to the extent caused by our own unlawful conduct.

24. Grievance Redressal & Contact

For any privacy concerns, data requests, complaints or account issues, contact us at: mygarbhakatha@gmail.com. Legal entity: MyGarbhakatha. We maintain a grievance-handling process as required by applicable law. For medical concerns or emergencies, this channel is not a substitute for a healthcare provider or emergency service.

25. Governing Law & Jurisdiction

These Terms are governed by the laws of India, subject to mandatory consumer and statutory protections. The parties will first attempt to resolve disputes in good faith. Subject to applicable law and consumers' rights to approach statutory forums, the courts at Satara, Maharashtra, India shall have jurisdiction.

26. Children's Privacy

The Service is intended for adults (18+). We do not knowingly collect data from minors, and will implement the consent and safeguards required by law before processing any such data if the Service is ever offered to them.

27. Changes to These Terms

We may update these Terms when reasonably necessary due to changes in the Service, law, technology or business practices. For material changes, we will provide notice within the app or obtain renewed acceptance where required by law. The “Last updated” date identifies the current version, and your continued use after changes constitutes acceptance.

28. Acknowledgement

By using the Service, you acknowledge that:

• MyGarbhakatha is a wellness, education and journaling platform, not a replacement for professional medical care;
• pregnancy-related decisions should be made with appropriate healthcare professionals;
• you are responsible for the accuracy of information you enter;
• you should stop an activity and seek medical advice when symptoms or circumstances warrant it; and
• you have read, or had the opportunity to read, these Terms before using the Service.
